Rentals

The rules governing rentals at 19th Avenue Lofts are clear in our governing documents (Declaration, section 10.3). We have clarified them as well as given a clear procedure for owners to follow on this page.

Rental Procedure

If you’ve decided you want to rent your unit, follow these procedures.

  • Notify the board you would like to rent your unit, and we will reply to let you know if we are below our rental cap. Contact us at 19thavenueloftsboard@googlegroups.com.
  • Prepare a lease you plan to use with your renters. The lease must conform to requirements in our governing docs (Declaration Section 10.3. Brief Instructions are below in the section "Leasing Requirements").
  • Provide your lease to the board and you will be added to the list of approved rental units.
  • Put your unit on the market and start renting. You have 60 days to sign a lease before your approval lapses.
  • Supply the board with a signed copy of your lease before tenancy commences. Email your signed lease to 19thavenueloftsboard@googlegroups.com. We will keep your lease on record.
  • Notify the board of each new lease term so that we have an electronic record of your rental activity. Notify us at 19thavenueloftsboard@googlegroups.com.
  • Pay the move-in/move-out fee for each new renter. See exceptions for Air BnB below.

Rental Rules

  • All rental units must be registered with and approved by the board.
  • Approval requires that owners submit a copy of the lease they intend to use and inform the board on each move-in (new renter) by supplying a copy of the signed lease.
  • The provided lease must conform to the requirements of our governing documents and must be submitted to the board before tenancy commences.
  • The board cannot approve more than 13 units to be rented at any time.
  • Any approved unit can be rented without any further approvals except we ask that you inform the board of each new renter and supply a copy of the signed lease before tenancy commences. Notify us at 19thavenueloftsboard@googlegroups.com.
  • Approval expires for any approved unit that remains unrented for more than 60 days or is occupied by a non-renter for more than 30 days. In practice, the board will only utilize this stipulation when there is a waiting list for approval. In short, when it comes to rental approval, you must use it or lose it. :)

Lease Requirements

The requirements for your rental lease are detailed in our governing documents (Declaration Section 10.3). We provide a short summary here for your convenience, but these instructions do not replace or supersede the detailed requirements explained in our governing documents.

  • Leasing agreements must be in writing.
  • There is no minimum lease term.
  • Lease must “provide that its terms shall be subject in all respects to the provisions of the 19th Avenue Lofts Declaration, the Bylaws, and the Rules and Regulations of the Association and that any failure by the Tenant to comply with the terms of such Governing Documents shall be a default under the lease or rental agreement.” (Your lease must include this language).
  • Owner must provide a copy of governing documents to renters (Declaration, Bylaws, Rules and Regulations).
  • Upon request, the owner must provide evidence that the unit has been consistently rented since approval was granted. Approval to rent a unit is automatically revoked if the unit is unrented for more than 60 days or occupied by a non-renter for more than 30 days.

Air BnB

Since our leasing rules set no minimum lease period, AirBnB rentals are allowed by the 19th Avenue Lofts Condominium. AirBnB operators should be careful to follow all leasing rules. Board Approval and all Lease Requirements apply. Since short term AirBnB style rentals typically do not involve moving furniture and other large personal items into the building, we waive the move-in/move-out fees for these types of rentals.

The contract's used by short-term rental sites like Air BnB are NOT sufficient to comply with our rental rules. You must sign an additional short-term lease agreement between you and your renter which complies with all our lease requirements. You must send a signed copy of your rental agreement to the board before tenancy commences. Email your signed leases to 19thavenueloftsboard@googlegroups.com. The e-mail history of this e-mail list will be used to verify your compliance with our rental rules.

To use your unit as Air BnB, you must use the following procedure.

  • If your unit has not be approved for Air BnB use, request permission from the board and provide the lease you plan to use with your renters. The lease must comply with the lease requirements summarized above .
  • After approval you have 60 days to sign a lease.
  • Before tenancy commences, submit your signed, short-term lease agreement to the board at 19thavenueloftsboard@googlegroups.com. Your signed lease is proof and paper trail of your active rental use.
  • After your initial lease, you must rent your unit at least once each 30 days and supply a signed lease to the board for each rental. This is our paper trail to verify your continued use of your unit as a short term-rental.
  • If you fail to rent your unit once every 30 days, your rental approval is revoked, but can easily be renewed by contacting the board before your next short term rental. As long as we have not exceed the number of allowed rental units (13) at the time, your approval will be renewed provided you supply a signed rental agreement for your new renter.
